Bill Elliott has investigated hundreds of criminal cases over the years, working with defense attorneys on behalf of their clients who have been charged by the state or federal government with having committed a crime. Bill Elliott has both the training and expertise needed to conduct critical case analysis that can often point to areas of reasonable doubt in a criminal case. In many of the cases we have assisted with, we have been successful in finding evidence to prove that the person charged with the crime did not do it, or we developed information with which to mitigate the circumstances. A young man who had been charged in Bernalillo County with MURDER and ATTEMPTED MURDER, had the charges reduced after our investigation showed that this man was in fact defending himself from gang members who had chased him through the streets of Albuquerque and had cornered him on the Interstate. We were able to identify and locate numerous witnesses whom the police ignored at the crime scene. The police told many witnesses that they had enough eye witness accounts and ordered these witnesses to leave. After our investigation, the District Attorney DISMISSED the murder charges and the young man ended up entering a plea of guilty to negligent use of a firearm and received a deferred sentence. A young man was charged in Bernalillo County with ATTEMPTED MURDER (6 counts), ABUSE of a CHILD (4 counts) and SHOOTING at or from MOTOR VEHICLE (7 counts) as a result of numerous eye witnesses who placed the young man at the scene of a drive by shooting in Albuquerque. Our investigation proved that the young man was not at the scene and in fact the witnesses were attempting to implicate the young man so that he would be convicted and sentenced to the state penitentiary where he was to be targeted for murder. The District Attorney DISMISSED all charges pending against the man. In Rio Arriba County New Mexico, a young man was charged with MURDER based upon the statement of the state's star witness. During the course of the jury trial, evidence developed during our investigation showing that the state's star witness was in fact the person responsible for the killing was introduced. The Jury was out for a very short time, before returning with a verdict of NOT GUILTY. As a result of our investigation we were able to show police misconduct in the state's investigation of the crime. During the state's interrogation of our client at the state police office, the State Police Agent conducting the interrogation read our client his constitutional rights under Miranda, then proceeded to identify another man in the room as our client's Public Defender. In fact, the man who was identified as the Public Defender was the Assistant District Attorney who was preparing a search warrant and criminal complaint in the case. A young man was charged with TRAFFICKING A CONTROLLED SUBSTANCE in Bernalillo County. The young man who was our client maintained that he had been the victim of entrapment. Our investigation determined that an audio recording of the transaction had not been turned over to the Defense by the government. The Trial Judge listened to the audio recording in camera and then ordered the District Attorney to turn it over to the Defense. The government refused and the Judge DISMISSED all charges against our client. A woman who was a corporate officer of a local Albuquerque company was accused of EMBEZZLEMENT of company assets and money. Our investigation proved that the lady was in fact the target of a Machiavellian plot by her brother-in-law, wherein the brother-in-law paid money to have co-conspirators make deposits into the woman's bank account and then come forward with incriminating statements in order to disgrace the woman in the eyes of her family to get her removed as a corporate officer. The woman was cleared of all allegations and the brother-in-law was removed from the company. We have also conducted investigations into cases post-conviction, in preparation for the filling of a Habeas Corpus Petition in which we looked for new or undisclosed evidence as well as searched for witnesses who might provide additional evidence. Please note that in federal court there is a one (1) year period after sentencing in which to file the Petition for Habeas Corpus, this period of time does not start until all appeals (if any) are completed. There is no time limitation in New Mexico state court on filing of a Habeas Corpus Petition. Please be aware that the successes set out above cannot be guaranteed in any case as each case is different. However, my expertise as a criminal defense investigator has made a significant contribution in most of the criminal defense cases that I have been involved with.
